1. Introductory Provisions

1.1. These End-User License Terms (hereinafter referred to as the “License Terms”) define the mutual rights and obligations between you, as the end user of the Ylands EDU educational application (hereinafter referred to as the “Software”), and us, BOHEMIA INTERACTIVE a.s., having its registered office at Stříbrná Lhota 747, 252 10 Mníšek pod Brdy, Czech Republic, Company ID: 27218864, registered with the Commercial Register maintained by the Municipal Court in Prague, Section B, File 9791, as the developer and provider of this Software (hereinafter referred to as the “Provider” or “we”).

1.2. These License Terms apply to the use of all versions of the Software. By using any version of the Software, you agree to these License Terms. If you do not agree to these License Terms, do not download, install, or otherwise use the Software.

1.3. The Software is licensed, not sold. The Provider is and shall remain the exclusive owner of all rights to the Software. All end-user rights regarding the Software are governed by these License Terms.

1.4. The Software may be used independently or in connection with the Ylands EDU service (hereinafter referred to as the “Service”). The Software may only be used in conjunction with the Service if you or your organization holds an active subscription to the Service (hereinafter referred to as the “Subscription”) in accordance with the terms and conditions of the Ylands EDU service. You acknowledge that the Service is not part of the licensed Software. These License Terms or your use of the Software do not grant you or your organization any permissions or rights concerning the Service, its components, or its features. The provision of the Service is governed by separate terms and conditions.

2. Your Rights

2.1. You may download, install, run, and use the Software on your end device. 2.2. You are fully responsible for all outputs created while using the Software (hereinafter referred to as “User Content”) and acknowledge all risks associated with creating or making User Content accessible to others. You understand that the transfer of stored data, including User Content, is part of the Service.

3. Restrictions

3.1. The Software may only be used in accordance with its intended purpose, i.e., for educational needs.

3.2. The following activities are strictly prohibited:

  • 3.2.1. Using the Software or any part of it for purposes other than teaching or education without our prior consent;

  • 3.2.2. Commercially exploiting the Software or any part of it, especially through distribution, monetization, resale, or other direct uses aimed at generating profit;

  • 3.2.3. Transferring the Software or any part of it to a third party, even partially;

  • 3.2.4. Making or creating copies of the Software, translating, processing, modifying, or otherwise altering the Software for any purpose;

  • 3.2.5. Exceeding or bypassing any technical limitations of the Software that restrict its use to certain prescribed methods, including;

  • 3.2.6. Disrupting, modifying, reverse-engineering, or decompiling the Software, any part of it, or any related files, data, or network services;

  • 3.2.7. Using the Software or any part of it in a manner contrary to the law or to create or spread malicious software; or

  • 3.2.8. Creating offensive or otherwise illegal User Content or infringing copyrights or other rights of others through the creation of User Content.

4. Warranties, Liability

4.1. The Software is provided “as is,” and we offer no warranties or guarantees, particularly regarding any functionality, continuous availability, or suitability of the Software for the intended purpose. We explicitly disclaim any liability for damages arising from the use or inability to use the Software. Even if the Provider were liable for damages, the maximum amount of compensation is limited to the amount paid by the injured party to the Provider in connection with using the Software.

4.2. We are under no obligation to develop or provide updates or support for the Software. By using the Software, you agree that updates may be provided remotely and automatically, especially for maintenance and improvement purposes.

5. Final Provisions

5.1. By using the Software, you accept and agree to these License Terms and confirm that you have full legal capacity. Otherwise, your legal representative must agree on your behalf.

5.2. If you breach these License Terms, we may unilaterally terminate the license contained herein with immediate effect and/or restrict or disable access to the Software. In such cases, you must cease any use or further distribution of the Software.

5.3. The Provider reserves the right to unilaterally modify these License Terms and will always publish the current version on the Provider’s official website. Continued use of the Software after the changes take effect is considered acceptance of the changes.

5.4. All parts of these License Terms are valid to the maximum extent permitted by law and do not limit any statutory rights under applicable laws.

5.5. These License Terms are governed by the laws of the Czech Republic, and all disputes arising from them will be resolved by Czech courts with general jurisdiction over the Provider.
